TrekStor vs E-Ink Patent Infringement Lawsuit Update(August 27,2013)

On August 27, 2013, the Mannheim Regional Court in Germany announced its first instance preliminary decision on TrekStor GmbH vs. E-Ink Corporation patent infringement lawsuit of EP1231500B1.  It decided to suspend the proceeding until the Federal Patent Court makes decision on the nullity action on the same patent since the court considered that the patent is highly likely invalid.

As OED’s lawyer estimates, it may take approximately two years for the Federal Patent Court to make decision on a nullity action in Germany.  The nullity action of EP1231500B1 was filed on February 4, 2013, so it may take approximately one and half years from now for the Federal Patent Court to make decision.

TrekStor’s marketing and sell of E-Book readers in German and European market are not affected, and will go on as usual.  OED’s marketing and sell in Germany and Europe are not affected either. OED will continue to actively market its e-paper display panels in Germany and Europe.
